What Should You Do After a Car Accident?

A Legal and Safety Checklist to Protect Your Rights

It’s normal to feel disoriented, shaken, or unsure of what to do next after a car accident. That initial shock can make it hard to think clearly, but your actions in those early minutes and hours can have a lasting impact on your health, safety, and legal rights.

AVA Law Group helps injured drivers during the confusing aftermath of car accidents every day. Whether you’re dealing with serious injuries or vehicle damage, this step-by-step guide helps you take control, protect your rights, and get the support you need.

Step 1: Check for Injuries and Move to Safety

Your first priority is your safety and the safety of others. Check yourself and your passengers for injuries (should you be able to). If anyone is hurt, call 911 immediately. Move your vehicle out of traffic to avoid further harm if it’s safe to do so.

Even if injuries seem minor or no visibale to the naked eye, it’s important to take them seriously. Adrenaline can mask pain, and some injuries, like concussions or internal bleeding, may not show symptoms right away.

Step 2: Call 911 and Wait for Help

GET A POLICE REPORT! Having a police report is vital if legal or insurance questions arise later. Cooperate with first responders, but avoid speculating about fault or making statements that could be misunderstood. For example, don’t apologize for the accident. It will be used against you.

If you’re physically able, note any visible evidence or road conditions like skid marks, weather, or road debris. This could be very helpful to you later.

Step 3: Document the Scene (If You Can Do So Safely)

Use your phone to take photos of:

  • Vehicle damage (all sides)
  • License plates
  • Road conditions and traffic signs
  • Injuries (if visible)

Try to get names and contact info from witnesses. The more information you have, the better positioned you are to protect yourself if disputes arise.

Step 4: Exchange Information Carefully

You are required to exchange insurance and identification information with the other driver(s). This should include:

  • Driver’s license number
  • Vehicle registration
  • Insurance carrier and policy number
  • Contact information

Avoid discussing the accident or who was at fault. Even a well-meaning comment can be misinterpreted and used against you.

Step 5: Get Medical Attention Right Away

Even if you don’t feel injured, get checked by a medical professional as soon as possible. Some symptoms take time to appear, and a medical record is necessary should you decide to pursue a legal claim.

Step 6: Notify Your Insurance…But Know Your Rights

Most insurance policies require prompt notification. Keep your report brief and factual. Decline to give a recorded statement until you’ve spoken to a lawyer. Many clients come to us after unknowingly damaging their own claim by saying too much too soon.

Step 7: Talk to a Lawyer Before You Settle

You are not required to hire a lawyer after an accident, but if you’re injured or unsure about your rights, it may be one of the most important calls you make.

Our attorneys can:

  • Explain your options clearly
  • Protect you from aggressive insurance tactics
  • Make sure you don’t settle for less than you deserve
