Over 6,000 Claims Filed for Complications with Hernia Mesh Implants


The number of hernia mesh lawsuits filed in the United States continues to steadily and rapidly increase as hernia mesh lawyers review and file more hernia mesh patients’ claims. In the past month alone, over 1,000 new product liability lawsuits were filed for complications with hernia mesh implants manufactured by Bard, Atrium, and Ethicon.

The latest MDL Statistics Report released by the United States Judicial Panel on Multidistrict Litigation (JPML) on June 19 revealed the total number of lawsuits currently pending in three different MDLs in the federal court system, each associated with the following hernia mesh implant types/manufacturers:

  • Bard – 2,478
  • Ethicon Physiomesh – 2,167
  • Atrium C-Qur – 1,403

These numbers are anticipated to increase as hernia mesh attorneys process and file more lawsuits on behalf of patients suffering from hernia mesh implant injuries.

Consumers across the nation are raising similar allegations against hernia mesh/medical mesh manufactures, stating their mesh products contained design defects that contributed to dangerous complications such as infections, recurrent hernias, or the need for painful revision surgeries.

All three of the companies associated with these mesh products are part of separate multidistrict litigations (MDL) across the country; Atrium C-Qur cases are consolidated in New Hampshire, C.R. Bard in the Southern District of Ohio, and Ethicon Physiomesh claims in the Northern District of Georgia. Along with the federal litigation, many state courts across the U.S. currently have hernia mesh cases pending in them. New Jersey, Pennsylvania, and Rhode Island are among the states housing a large volume of hernia mesh cases within their court systems.

Bellwether processes have been established for each of the current hernia mesh implant MDLs in order to anticipate how juries may react and respond to evidence and testimonies brought forth and likely repeated throughout the thousands of trials. If settlements are not reached with the various hernia mesh manufacturers at the trial process, each of the cases pending in the litigations will be remanded back to the U.S. District Courts they were originally filed in for individual trial dates.
