Colorado Statute of Limitations on Sexual Abuse Changed

In early 2021, Colorado completely removed the statute of limitations for civil claims of child sexual abuse. Previously, sexual abuse victims only had six years after the abuse happened or to the age of 24 to file a civil lawsuit against their abusers or institutions that hid their abuse. Now, the statute of limitations has been removed. Victims can now file civil claims for sexual abuse at any age, no matter how long ago the abuse happened. Additionally, on June 8, 2021, Colorado opened a three-year “lookback window” that opens new opportunities for Colorado sexual abuse victims to seek justice for their abuse. During this three-year window, Colorado sexual abuse claims that were considered expired or ineligible under old statute of limitations can be revived, meaning past sexual abuse victims may receive a second chance to hold their abusers accountable in Colorado’s court system.
